This Site provides information about SAFER EXPERIENCE and its process safety engineering, consulting, and technology services — in particular the WSH Knowledge AI-powered expert system for the steel, mining, and process industries. Content on the Site is offered for general guidance and to provide visitors with general information of interest about our activities.
1.2 Intended Audience
The Site is intended for business professionals, enterprise clients, and prospective clients in the steel, mining, and process industries. It is not directed at consumers or at individuals under the age of sixteen (16). We do not knowingly collect personal data from children through the Site.

Use of our trademarks requires our express prior written permission and, where applicable, a license agreement with SAFER EXPERIENCE. Unauthorized use of these and any other marks in our portfolio will be prohibited and prosecuted to the fullest extent permitted by law. 3.4 WSH Knowledge and AI Platform
The WSH Knowledge platform, together with all curated content, embeddings, vectors, metadata, enrichment layers, knowledge graphs, concept indices, system prompts, retrieval logic, and AI outputs, is the exclusive intellectual property of the Provider. Nothing on the Site grants any license or right — express, implied, by estoppel, or otherwise — to access, use, reverse-engineer, extract, replicate, or derive any part of the Knowledge Base or underlying platform technology. Access to the WSH Knowledge service is governed exclusively by a separate written Service Agreement.
3.5 Feedback
If you send us any comments, suggestions, feedback, or ideas about the Site or our services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to use such Feedback for any purpose, without any obligation or compensation to you.

Any waiver must be in writing and signed by an authorized representative of SAFER EXPERIENCE to be effective.
12. Entire Agreement
These Terms, together with our Privacy Policy and any additional notices or disclaimers posted on specific pages of the Site, constitute the entire agreement between you and SAFER EXPERIENCE regarding your use of the Site and supersede all prior or contemporaneous agreements, communications, and understandings (whether written or oral) relating to the same subject matter.
These Terms do not govern access to or use of our platform services — including the WSH Knowledge platform — which are subject to a separate written Service Agreement executed between the Provider and the relevant client. In the event of any conflict between these Terms and such Service Agreement with respect to platform services, the Service Agreement shall prevail.
13. Governing Law and Jurisdiction
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
Any dispute arising from or related to these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the courts of Luxembourg City, Grand Duchy of Luxembourg, without prejudice to any mandatory consumer protection rules that may apply where a user qualifies as a consumer under applicable law.

If you do not agree with any modifications, you must stop using the Site.
9. Indemnification
You agree to indemnify, defend, and hold harmless SAFER EXPERIENCE, its founder, employees, contractors, agents, suppliers, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal and professional fees) arising from or related to: (a) your use of, or inability to use, the Site; (b) your breach or alleged breach of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement or alleged infringement of the rights of any third party, including intellectual property rights and privacy rights.
10. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the Parties' original intent.
11. No Waiver
No failure or delay by SAFER EXPERIENCE to exercise any right or remedy under these Terms shall operate as a waiver of such right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further exercise of that or any other right or remedy. Any waiver must be in writing and signed by an authorized representative of SAFER EXPERIENCE to be effective.
12. Entire Agreement
These Terms, together with our Privacy Policy and any additional notices or disclaimers posted on specific pages of the Site, constitute the entire agreement between you and SAFER EXPERIENCE regarding your use of the Site and supersede all prior or contemporaneous agreements, communications, and understandings (whether written or oral) relating to the same subject matter.
These Terms do not govern access to or use of our platform services — including the WSH Knowledge platform — which are subject to a separate written Service Agreement executed between the Provider and the relevant client. In the event of any conflict between these Terms and such Service Agreement with respect to platform services, the Service Agreement shall prevail.
13. Governing Law and Jurisdiction
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
Any dispute arising from or related to these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the courts of Luxembourg City, Grand Duchy of Luxembourg, without prejudice to any mandatory consumer protection rules that may apply where a user qualifies as a consumer under applicable law.
